Although there may not be enough available medical data to satisfy the burden of proof in a legal case against Insurance Companies or any other liable party, the consumer has every right to make a claim when damages occur. It is the consumer's iniciative to the solution to the problem which can very well be the lack of medical data as opossed to his right to make a claim. Let's not forget that since these are mostly civil cases, the burden of proof is not required but rather a preponderance of evidence is what we are looking for to make judgement.
