My daughter was involved in a hit and run in Chicago with an illegal alien, who was followed and arrested in Indiana, where he apparently lives. He was also issued a DUI at the tie of his arest for hit and run. The Chicago police did not complete the reporting necessary to determine whether the car the alien was driving was insured. We are searching in Indiana to try to get an accdent report. To top it off, my daughter's substandard insurer says that her license was revoked 4 years and 10 months ago (they have a 5 year underwriting clause) and they have rescinded her insurance. They dis so although she has been insured with the agency for 4 years. The Illinois Insurance Bureau so far has said that since this was a "1st term" policy (daughter's agency switched the name of the insurer for her new policy)the company had done nothing wrong. Even though the "agency" (separate from the insurer) sent her an application completely filled in (suggesting that if anything were wrong she could change it) and asked her to sign it.
I know there is seldom justice, particularly in the insurance and illegal alien game. However, isn't there something we can do? Recover from the uninsured motorist fund? Force insurance arbitration??
Help!!!
