Subject: Subrogation versus Personal claim
Due to a faulty contractor misrepsenting himself to move a fireplace in my new house, he burnt down half my house and almost killed my family. State farms is handeling the subrogation case against the contractors insurance company...a true no brainer. The question at hand is can I personally sue the contractor for the severe trauma this fire has caused my family while the subrogation is in process?
Please advise.
