I have a Workers Compensation lifetime medical settlement from 2003 for a lower back injury. My insurance carrier claims adjuster, AIMS, informed me that I am only entitled to 24 provider visits for this injury. It was indicated that although my injury and settlement agreement occurred prior to SB 899 inactment date of 4/2004, a "grandfather" clause allows them to apply this restriction to my settlement agreement. I am currently in the process of a buy-out for lifetime medical, as they are not authorizing regular treatment and I feel I will be better able to control my future medical care. Please advise me of the validity of their statement about a grandfather clause and what can I do at this point.
