As a former applicant attorney who ceased practicing workers' comp law because the SB899 reforms reduced P.D., and therefore attorney's fees, to about 1/3 of their already low amounts, I realize many may feel I have no credibility in commmenting on SB899 because "my ox was gored". However, let me just point out one observation. The Schwartenegger administration announced that one of the intentions of SB899 was to "get attorneys out of the system". While I have noticed that many former applicant attorneys no longer praactice comp law, the defense firms still seem to be getting plenty of cases. Why would this be true, and what are the implictions of this for the fair delivery of benefits to injured workers?
