I KNOW they don't have the right. I already agreed with you on that point. My point, if you would actually read, is that they don't have the right, meaning they are afforded LESS rights than I have right now. Giving them the same right to marriage would only put them on EQUAL footing, not give them special treatment.
Judges are there to interpret laws, and in many cases they have indeed overstepped their bounds to effectively legislate from the bench. I think Miranda is a lousy example because he wasn't afforded the opportunity to excercise his Constitutionally protected rights (hence the requirement that everyone now be informed of them), but I concede your point.
