You're an adult, if you're too stupid to know that smoking is bad for you then smoke up. If I own a business and don't want your cigarette smelling money in my establishment I'll ban smoking. If you're too stupid to know wearing a seatbelt (or helmet) may save your life then sign up for your Darwin Award.
But, if your choices directly result in your injury you don't sue... you deal.
