Smitty needs to learn a little about insurance, and so does the court. The Association is standing between the owners and insurance that the owners paid for. Most good policies define coverage as "all in". The only exclusion is for personal property. Smitty a "condo" is the air space inside the walls. Research Condo vs. townhouse. Most Condo policies state that they are primary and non-contributing with any individual insurance purchased by the unit owner.

If I were the owner, and paid the premium, the next thing I would do would be to organize a recall against my board.
