The court of appeals ruled that the insurance clause of the Maryland Condo Act was ambiguous and therefore ruled in the associations favor. As everyone knows a condo association is governed by it's BY-Laws, which are deeded and recorded. The court can't change the By-Laws only a voting majority of the unit owners can change the By-Laws. If the current By-Laws state that the association MUST insure the Complex and the units, then until the By-Laws are changed the board of directors has no choice but to honor the By-Laws. Since mortgage holders are also insured by the associations certificate of insurance, they also must be advised that the insurance they require will be changed, so that they can call their loan for failure to protect their investment. Someone needs to read their By-Laws, the court of appeals can't change them with the stroke of a pen.
