I agree, it's no wander agents get sued.
Here is the insurance section of the law requiring the association to insure real property - including the unit (I can't make this up, it's in the statute):
11-114. Required insurance coverage; reconstruction.
(a) Duty of council of unit owners to maintain property and liability insurance.- Commencing not later than the time of the first conveyance of a unit to a person other than the developer, the council of unit owners shall maintain, to the extent reasonably available:
(1) Property insurance on the common elements and units, exclusive of improvements and betterments installed in units by unit owners, insuring against those risks of direct physical loss commonly insured against, in amounts determined by the council of unit owners but not less than any amounts specified in the declaration or bylaws;
It's an original specifications wording, as is the Uniform Condominium Act.
What you are talking about is the definition of a unit, this spells out who has to insure it. Notice the phrase "...the common elements and units..."
