Oh, brother! Don't start me on this one. Scam? Probably. First off, the parents did have a car seat and were using it (most likely, daily)so I will assume they were concerned with their child's safety. Now, how many parents secure their children into a car seat each and every day as part of their routine? Do they check the seat EACH time they buckle their child into it? They should but probably don't. Can't throw around labels such as negligence for any human error that may occur during the course of our lives. When anything goes wrong everyone in this society looks to point the finger--and it's always in legal terms--many times trying to make an average person out to be a criminal. Sometimes even a conscientious person is in a hurry, forgets, should have/could have done something differently, procrastinates, but this doesn't mean they should be sued in EVERY case. Logic should prevail but rarely does.

If this is not a scam and is truly a real lawsuit, tragedy for all involved. If I were a mom who had this happen and a family member sued me, I would be mortified and heartbroken. A shame the courts perpetuate these kinds of time consuming, money wasting cases. In this situation, the scenario is being milked for all it's worth. Even if the parents don't receive the money directly, there has already been one settlement in the past. Suing from every angle because you can is not right. This happens all too often with the legal system--even with less grand cases that never make it to the papers. Individuals and entities settle behind closed doors whether they are at fault or not, many times just to avoid the high court costs. The legal system forces people/companies to make a choice between the lesser of two evils. I'm not saying this happens every time--just often enough to keep the wheel spinning out of control when it comes to lawsuits and who really benefits in the shaky outcome.
