Grouchy, This is exactly the problem. Most brokers (I have worked in this area for 30 years, so I'm talking from first hand experience!) operate as brokers, but also engage in agency agreements with the carriers, so they are acting in both capacities at once. This causes the conflict that the NAIC model is attempting to resolve.
