The model act proposed by the NAIC does not specifically require that the compensation arrangement be filed with a government agency, only that it be disclosed to the consumer. By the way, you would often be required to file financial information with an insurer. Disclosure of financial information by a privately held brokerage firm should be reasonable where a potential conflict of interest exists. As a privately held broker, I would have not qualms about complying, and I have disclosed this information to customers where requested or where appropriate in the past.
