You asked which lawyers are making a killing off of PIP? Go to any Courthouse in Florida and pull a docket. Look for any medical provider v. any insurer. Then, look at the certificate of service on the Complaint or Statement of Claim.
Also, it is truly amazing how many people are injured to require the exact same treatment but magically heal after $10,000 has been spent.
I will not argue with you that there are many times when the insured is severely injured and PIP is necessary, but in those cases it is typical that PIP is paid out very quickly. However, I would argue that most, if not all, insurers do NOT train their adjusters that all claims are fraudulent. It has been my experience that most adjusters are trained to find reasons to pay the claims.
Since you asked, I do work in a Defense firm. It seems you work for a Plaintiff firm, am I correct?
