Diana: your PIP policy states:
INSURING AGREEMENT
A. We will pay ...PIP benefits for an "insured" (defined as you, etc) who sustains "bodily injury" (you know the definition). The "bodily injury" must be caused by an accident arising out the ownership, maintenance or use of a "motor vehicle" (defined as a self propelled vehicle with at least 4 wheels or more which is designed and REQUIRED to be licensed in the state of FLORIDA). That Ohio vehicle is not a "motor vehicle" a motor cycle is not a motor vehicle, a moped is not a motor vehicle, a backhoe, cherry picker, etc are not motor vehicles. So there are many instances in which PIP will not afford you protection. But your policy clearly states what it covers. Most people, myself included purchase coverage becaue someone requires us to and we don't read our policy until we have a claim. But don't blame the insurance company for denying your un-covered claim, blame yourself for not knowing what you purchased. I am more interested in why Medicare is not paying your bills. They should send you an EOB (explanation of benefits) for each bill they review and pay or deny. Initially I can understand that they may have prefered FL PIP to pay, however, upon receipt of a denial of PIP benefits, they should be providing you with coverage. Sounds to me like you need an agressive advocate.
DF Davis: your situation is equally unfortunate. However, when you travel abroad (as I do frequently) you do so at your own peril. You cannot expect to have the same protection under the law in a foriegn land, that you have at home. Just curious, what is the minimum insurance requirment in the UK?
