TPG: I must have done something right if you actually almost recommended mandatory BI or UM. As for striking a nerve, absolutely! I think we both struck one. I don't like to be grouped with other providers as well as you probably don't like to be grouped with other attorney's. Also, my clinic does free work outside off PIP all the time. As I have already written, I agree with you that there are some unscrupulous clinics, doctors and plaintiff attorneys. My answer, whether or not there is mandatory BI, UM or PIP, is still to regulate and investigate. Also, something you refuse to recognize, to hold insurance companies and insurance defense attornys accountable. I am very familiar with the kind of cases you see, and yes, there are many mis-managed, just as there is in group health, medicare/medicaid and worker's comp. You still have failed to admit that there are insurance defense attorneys who are overzealous in defending their clients to the point of using any argument to help insurance companies from not paying enough or at all. In addition, you also fail to state that there are insurance companies out there that as a "standard course of business" engage in practices that are detrimental to their insured for the sake of their bottom line. Maybe you only represent one insurance company who is legitimate. If you do, then great. If not, then you know what I'm talking about.
You have brought up key issues on PIP. I never disagreed that the system isn't flawed. I only suggest that no system is no solution at all.
