I agree there are some defense attorneys that come up with creative arguments to help their clients. However, they usually lose. Most of the judges that look at these lawsuits tend to rule in favor of the medical providers. A
As it relates to not looking out for the best interest of the insured, I, personally, have not seen that with any of my clients. In fact, if they did have a policy like that it would be clear bad faith and expose them to severe penalties.
