Let me get this straight: a woman could theoretically file a stress claim for WC after being subjected to sexual harrassment from her boss (which inherently is a personal "attack"), at work, and the insurer would not hesitate to accept it and go through the normal protocols; in the same state, a woman is physically attacked by her boss AND his wife at work--kidnapped, even--and the insurer is balking because they say the attack was motivated by "personal" reasons? Denying a claim if it's determined the claimant caused the injury themselves (unsafe behavior or horseplay) is one thing; denying a claim that clearly resulted in injuries caused by another person is ********!! That woman should sue the insurer and the employer in court for bad faith practices. There is evidence supporting her claim (hello: police reports, media coverage, med bills to name a few) and there's no way the carrier should be getting away with denying this claim!
