I don't know what the law is in your state BUT, I do know in California, YOU ARE ALLOWED TO SUE YOUR EMPLOYER PERSONALLY? Or, it may have been the spouse can. Anyway, when my spouse gets done with his WC case, the PEO (WC provier) who did not have insurance at the time of his injury, Paid to date this year: $7,672.00. I will be suing him for damages, just like OJ's in-laws did. Personally/Individually. For pain and suffering, all that stuff. I have the documentation to prove it. I am just the spouse though.

See if that's an option in your state. Your attorney would definitely know the answer to that.

Then make your decision.
