I do medical malpractice for a living, and I think the effort should go to 'weeding out' the real cases where someone is to blame.
I have insured a doctor where the LAB switched pathology results. Doctor read the report that was sent to him. A woman without cancer was operated upon, and a woman that did have cancer was delayed in treatment. Doctor paid out $750K to each. Pathology lab paid $1M to each. Why was the doctor at fault? Yes, the lab should have been held accountable for what they did. But the doctor only had the report to go by.
Another case- doctor prescribes pain med for patient. Patient's SON overdosed on meds. DOCTOR paid out max limits.
THAT'S where the energy/effort should go. Stopping people from blaming everyone for one person's mistake, or everyone else for their own mistakes.
Similar to the cases where someone breaks into a house, gets hurt and sues the homeowner and WINS. Criminals don't need to rob anymore. They make more tripping and falling in the course of a breakin these days.
