I have issues with jury trial in the sense that they feel 'sorry' for the victim. In the case of the mistaken cancer- I felt sorry for the patients involved- but the pathology lab was 100% at fault. The problem is that a jury will just want the patients to get all that is available.
Case in point- a crack addict was pregnant. It was documented in every file that she had been advised to stop smoking crack. Her baby was seriously afflicted. Due to this being the result of drug addiction, none of the insurance companies wanted to settle. It went before a jury. The jury felt sorry for the baby and awarded maximum policy limits on almost every doctor that even signed his name on the file. The mother walked away with almost $3M. There was not 1 doctor at fault for this, yet they were held responsible.
THAT is what I'm talking about. Then you have the situation where a doctor that actually made a mistake has no insurance. Every other doctor/facility involved has to reach into their pockets.
