Wow... lots of issues today...
1) Remove the emotion, racism, and irrational comments, and make this a business debate forum with professionalism as it belongs to be treated.
2) Employers that knowingly hire illegals should suffer the consequences, both in the policy exclusionary language, and the penalties applied by the government. We don't know what happened here, but if they knowingly hired, then address that issue, on it's own, in dealing with the employer only.
3) Separate the "wrongs" here. Regardless of how the employer behaved, deal with the employee according to his own actions. If he is an illegal, then he does not deserve treatment as a citizen. He should be given no status in any civil court as a plaintiff. He should be deported. While that sounds like the employer "got away with something" on the WC side, that's just not true. If they hired illegally, nail them on that issue. Then again, there is quite a business in providing false documents, and employers can be duped -- so don't punish them because they were defrauded by a criminal.
4) Get political, and learn the basis for the problem. If the illegals were all deported on the same day, we might not function the next day here in the southwest... because our citizens will not TAKE these jobs (or at least certainly in the numbers required). Work with politicians to support the ones that are trying to create logical worker programs. This labor force is valuable to us, and if we do it right, those that are illegal now would be happy to BECOME legal, thereby fueling our future workforce with hard-working well behaved citizens.
5) Illegals do pay SOME taxes, but don't think for a moment they pay their fair share, just because they have something deducted from their payroll check. Typically they claim the highest dependents, etc, so they pay the lowest tax rate possible. That's not right. Yes, they pay things like Sales taxes... but just because they pay SOME taxes does not mean it's fair. And don't claim that they do not have representation, either -- because they do find ways to do that as well, with documents and voting that is not as secure as you might like to discover.
