Yes, probably four or more WORKERS are living in an apartment as the minimum wages they earn to not allow them to rent a luxury condo. Come on, these guys are working jobs no one else will take and that are pretty dirty and low pay. They do not import their family and grandparents cousins etc, they send most of what they can back home. I repeat, how do you come across with they do not have to pay taxes: wages are withheld, seems the government wants its cut for social security, state tax, SDI etc unless the firm has really gone around the bend.
Secondly the WC policy is wage based and the company is paying for this injury. Why do they now not want to use it; they can weasel out and avoid an uptick on their XMOD next go around. I remember growing up in a semi rural area when payday came some of the ranchers would just call the INS and deport the workers in lieu of pay as there was always a ready supply.
We need to work both ends of this problem, the jobs are there and the employers need the low cost workforce; why do we seem to have such a problem on an outcome both parties desire?
The court is not voiding law it is finding that if you hire some one knowing they are illegally in the country you cannot escape your obligations to them by that fact and must provide benefits MANDATED by state law to your workers.
