What does any of your questions have to do with the fact that the convicted man chose to file a false claim and receive benefits that were not rightfully due. You make it sound like the employer was at fault. I am employed by State Fund, and I can tell you that after 12+ years, nine in the legal department, I have seen that State Fund will vigorously prosecute any workers' comp fraud, whether it's committed by the employee or the insured.
