This was only a trial judge decision. It has not seen (and may not see) appellate review. It is not precedent for anything except a lot of good wishes and hope by the applicant's bar. The WCAB, in its en banc decision in Costa, already determined the new rating schedule is appropriate. This local workers' compensation may very well be correct, but its a long way from being over based on this decision alone.
