J. Doe I completely agree with your comments about being punitive.

The question then gets amended to was this an intentional violation (meaning that they were aware of the rules and intentionally trying to avoid them) or a legit business owner not doing their homework and fully understanding the rules?

That answer then should reflect the punishment. If intentional then hit them hard, if simple mis-understanding then perhaps focus on fixing the problem/situation.

If the size of the fine results in an uncollectable judgement who wins?

Owner could simiply sell off the assets to another person/entity and re-hire the staff using correct accounting/pay procedures...which then protects everyone...but maybe if the goal was corrective this could have been accomplished with out the sale....

I guess I am just to moderate for this insanely liberal state ...
