A key driver of the high costs in Montana workers' compensation is the loophole on exclusive remedy which allows tort litigation based on "bad faith" when employers, carriers and servicing agent deny a claim or a specific benefit within a claim. Legislative action to remove this loophole would go a long way toward reduction of workers' compensation costs.
