Conn. Man Sues NYC Bike-Share Operator for $15M After Crash

    Seriously? The old feller hit the low barrier so hard he flipped over the bike?

    Per this article, the barrier was located next to the bike rack. What speed does one have to carry to hit the barrier and flip over te bike? And what speed did he expect to ‘dock’ the bike with? Was he expecting to skid into the rack and jump off like a teenager?

    And I’m sure he was wearing his protective headgear!
    How long ago did this occur as I’m told many head injuries with loss of taste or smell don’t automatically create a permanent loss of taste or smell. I can attest to it because it happened to me and I’ve regained +- 90% from my fractured temporal bone injury.
    Guess I didn’t have the right legal eagle huh?!

    “The city’s contract with Citi Bike’s operator makes the operator’s insurance company responsible for any lawsuits and protects the city from claims.”

    If it was the city’s fault for not having the barrier painted yellow, how is the bike company liable, especially if there’s a clause in the agreement stating it’s the operator’s insurance company who has primary coverage?

      Liability the operator assumed in the contract. They should be liabile if they are the operator. The City is just the owner.
