    I had no idea those were so iconic. I thought they were just weird bollards that they had at some of the stores.

    Certainly makes me appreciate them a bit more both as a branding effort and a potential GL exposure.

    Ah, yes. Target should have known that those red balls would eventually be grazed by a vehicle, causing them to come loose and roll into another car. Seems like the lawsuit has to claim a ‘reasonable expectation’ on Target’s part – otherwise you only have the driver of the truck to go after. Much less lucrative…

    Hate to sound like broken record but we need to hold the ambulance chasing contingency fee lawyers personally liable for costs when they file these frivolous suits. I concur that she has certainly property damages she is due but the remainder come on, just another person playing the lawsuit lottery.

    Psychological damage? What type? Fear of red balls? Fear of trucks? Maybe just scared to go to Target anymore, maybe one the signs on the outside of the building might, might, might, fall off and hit her car again. For a cement ball weighing 2 tons $3300 sure isn’t much damage. Not even enough force to deploy airbags!! Sounds like a money chaser to me. Surprised she isn’t asking for 1 million.

      Perhaps the adjustor was just going to pay her ACV on that Rogue and it had 100,000 miles on it.

      Even a 2-ton ball can’t do a lot of damage when it hits the car at 5 miles per hour. 2 tons is about the weight of a mid-size pickup truck.

      I would like to know this as well. Although $100k is still too much even if she was, it would be nice to know if she could have actually suffered bodily injury due to her location in the vehicle relative to the point of impact.

        She was driving the car. The ball rolled about 15 feet and hit the driver’s side door at about 5 miles per hour. The only visible damage is a red dent in the door.

        Yes, you are right. I asked PolarSyndrome what it would mean if a weather forecast said there was a specific chance of rain, and his response was that the forecast couldn’t be trusted because the forecasters were probably biased. It’s a joke, there’s nothing they won’t believe from certain sources and nothing they will even consider if it’s not from those sources. They can’t even consider hypotheticals without falling back on their reflexive garbage. Of course in this case he also didn’t know the answer despite claiming to hold a degree in statics.

            His point sir is that no one in the history of the republic has been attacked so strongly by the media in the beginning of an administration.

            I am certain that President Trump could call for a ban on “assault weapons”, which by definition are no longer available to the public to purchase new, and the media would hate him for that as well.

      U/W Although I understand the premise of your comment, do you really think that anyone could have planned on someone hitting a red ball in front of Target and it becoming dislodged and rolling into another vehicle. Get a grip are you going to next advocate for suit against the highway department when a rock comes loose?
