It may have been a disgusting ordeal, but as was point out: no loss of life, no major injury, no compensable damage. NO point in taking this one to court! Take the offered settlement and if you don’t want another cruise, pass it on to someone else as a gift. If you are motivated by money, then sell the freebie.

So what if the settlement doesn’t covered my expenses? Which in my case, it doesn’t. There are lost wages, and cancel hotel stays for 2 nights to say the least. Now we’re talking about $750 for just those two items. They only offer $500.
And prove your loss.
How can you sue for lost wages? No one made you take the time from work to go (assuming you weren’t offered some sort of PTO or vacation time). (This is a real question, not some sort of sarcasm to make me sound superior.)
You cannot just sue for emotional distress and expect to win. Emotional distress is usually partnered with life altering injury or loss, like death, dismemberment, bodily injury, chronic illness, damage to reputation, etc. The author of this article is simply telling it like it is. You’ll notice the lawyers cited in the article make their money suing cruise lines. They are the ones saying there is no money to be had in this situation given that no one had so much as a sprained ankle on the ship.
However, this will change very quickly if passengers start turning up with diseases that can be associated with conditions on the ship a month from now.
Hel-looo…..It’s obvious, read the ticket (contract, educate yourself and purchase (wait for it….) travel insurance!!!
at the end of the article you mentioned that Doctors and Medical Personel on Cruise Ships are Independent Contractors and the Doctors are probably licensed in Belize, Dominican Republic or other 3rd World Countries
This is the Equivalent of some Doctors in the US that do not carry Malpractice insurance and have a sign at their door stating so. So the patient has the option of seeking another Doctor or Hospital
So the sick patient at the Cruise Line has the options of:
1 Refusing Care from the foreign Doctor of dubious qualifications
2 Accepting the Care from the Doc which the patient does not have any recourse in case of severe disease or death
Looking at the Bright Side, if the patient dies at sea, the dead patient should have requeted a Burial at Sea from the Cruise Line

I’ve never been on a cruise and after reading this and watching a recent newsprogram (I think it was 60 Minutes) I will not be going on any cruises.
That is a shame because most cruises run smoothly and it’s a great way to take a trip with family members who don’t know what they want to do each day. Rather than get bogged down with not doing anything, you can pick and choose your activities and meet for meals or at the end of the day.
