    Again, when was the Constitution changed so that Obama could single handedly change any law he wishes which was passed by both houses of congress. Should not any change in any law be approved by both houses of congress and the President before it can be changed? Or is our President subverting the Constitution, a document he swore to uphold when he took the oath of office?

        I am familiar with the phone and pen clause. After all, our leader has been spouting it for a couple of weeks now. We will get another dose of it with the State of the Union this time. Our Imperial President wants to rule with a pen because Congress refuses to implement his agenda. He reminds me of a petulant child who doesn’t get his way and then throws a tantrum.

            Have none of you heard of Executive Orders? A President does them to implement policy to the various branches of the government. He uses a “pen” to sign them. In Obama’s case, he is seeking to make an end run around Congress by implementing his agenda since they won’t go along with him on many issues. In some cases, it is circumventing existing law. How many times has he changed Obamacare so far by Executive Orders? In the case of the phone, if he wants something done right away, he merely calls a minion like a Czar and has them implement his agenda. Is this clear enough yet? Do we have an Imperial President or what?

            Agent – you’re so off base, you can’t see straight. Obama has issued 160 executive orders since 2009. Bush issued 197 executive orders for the same period of time in his presidency.

            And there has been NOT ONE excutive order issued in regards to the ACA.

            The delays are at the authority of the IRS. This same authority has been used by other administrations.

            You have zero credibility on this site.

            How so? Is he supposed to sit by and do nothing because Congress is in gridlock? If he did that, surely everyone would be up in arms. So he acts and everyone is still up in arms. What would make people happy other than his total disappearance?

            He’s not the first President to use executive order to get stuff done. As I pointed out to Agent earlier, Obama has passed fewer executive orders than Bush did at the same point in his presidency.

            It’s just plain hatred for the man, that’s all.

            Libby, you take naivety to a new level. Here we are talking about what Obama has stated in the past few weeks on what he is going to do and you drag old numbers from the waste basket from 09. The way he is talking, he may issue 160 Executive Orders in 2014 alone and we aren’t going to like many of them. If I read you right, you are saying that his proclamation of delaying the Employer Mandate for one year is not an Executive Order. I think it was implemented so I think it was an order to do so.

      Dave – this is not a Constitutional issue, it is an Administrative issue. The law is not being changed, only delayed.

      Administrative authority is granted by section 7805(a) of the Internal Revenue Code. This authority has been used to postpone the application of new legislation on a number of prior occasions across Administrations.

        And this is why congress will not pass “comprehensive” immigration reform while this liar occupies the White House. A big part of “comprehensive” immigration reform is securing our borders. Obama and his ilk see a huge number of Democratic voters potentially crossing our southern border. So a bill gets passed, it includes greater border security and the liar chooses not to enforce it.

            Actually Libby, I didn’t down thumb you for insinuating Walker could one day be President. Many of us hope he will continue to rise and make a run for it. He does seem to govern with common sense and has survived in a heavy union state which is quite an accomplishment. I do hope he takes action against the Teachers Union that allowed a teacher to continue teaching and getting back pay after he was caught watching porn while in class. We don’t need teachers doing that in school. Teachers Unions will support any of their members no matter how bad they are.

    I believe the point of the story is that the delay is further evidence that Democrats had very little idea of what they passed or its impact. “IRS officials said they were wrestling with complicated questions like how to measure the value of employee health benefits, how to define “highly compensated” and what exactly constitutes discrimination” So why was this provision stuck in? Because it sounds good and helped sell the ACA to the little information voters.
    Oh and California has recently declared they will be successful in reaching their enrollment goal – it is just going to cost the tax payers a mere 6 billion more per year because, surprise, surprise – there is a disproportionate number of Medicaid and subsidized enrollees to the total! But what’s a few billion? Certainly not worth what it used to be or will be in a few short years.

      Most voters were in favor of the idea of health insurance for all. That hasn’t changed. This is just turned out to be a bad way to accomplish that. Don’t blame the voters.

          If providing health insurance to all is a “Progressive Agenda” then so be it. I don’t think it’s Progressive as much as it is Humane and Civilized. But you obviously don’t feel the same way.

            I think “providing health insurance to all” is not the same as “providing quality health CARE” to all. If you can afford to buy the policy (with or without the subsidies), and then you find out your co-pays and especially your deductible are sky-high, so you must go thousands of dollars into debt before the policy even kicks in to start paying your bills – and you find out the pool of doctors you have to choose from is very limited – and you find out the pool of hospitals you have to choose from is very limited – how is that going to ultimately be “humane and civilized?” Health insurance is not the same thing as health CARE.

            I don’t understand why single payer is seen by some as such a vast improvement. If we already are seeing, under what we have just starting out with Obamacare, limited choice in doctors and hospitals, to name just one bad thing, doesn’t it make sense to think this would get exponentially WORSE if the government is in charge of deciding what and who and how much to pay? I wish someone could give, without sarcasm or snarkiness, three bullet point reasons as to why single payer would be so great, and someone else, without sarcasm or snarkiness, would give three bullet points as to why single payer would be a gigantic failure. I just know I don’t want the government anywhere near my health care or my doctor. That scares the living daylights out of me!

            I’ll give you more than 3:

            1. Everyone would have access to quality care.
            2. We can develop a centralized national database which makes diagnosis and treatment easier for doctors.
            3. Medical professionals can concentrate on healing the patient rather than on insurance procedures, malpractice liability, etc.
            4. Free medical services would encourage patients to practice preventive medicine
            5. People will have an easier time starting their own business, changing jobs or working part-time if health insurance is covered.
            6. Patients with pre-existing conditions can still get health coverage.
            7. Profit motives are taken out of healthcare expenses.

            Reasons against single payer –
            Taxes would skyrocket for everyone.
            No Profit Incentive would reduce any incentive for further research.
            No incentive to work past “normal working hours” would reduce access to health care.
            Research Canada and England – there is a back log of patients waiting on life saving procedures. People with Private Insurance in them countries are always the first seen. It would have an UnLeveling Effect on access to health care.
            Do you really want a politician making your health decisions based on Dollars and Cents?

            Tort Reform and a single bill er would be a huge reduction in cost. This is obvious, but yet completely ignored by ofnbama. Didn’t want to upset the Personal Injury Lawyers (I guess) ….

            Taxes wouldn’t necessarily skyrocket, FFA. What if we stopped foreign aid to Syria, Egypt, and other hostile nations? We would use that money for healthcare for U.S. citizens.

            No profit would help make healthcare more affordable and would have nothing to do with research. Research is done by universitites and pharmaceutical companies.

            Don’t know why people wouldn’t work as hard. What does access to healthcare have to do with that?

            We’re America. Surely we can build a better mousetrap that England or Canada.

            And no, a politician wouldn’t be making my healthcare decisions. My doctor would.

            We agree 100% on the foreign aide thing. We need to take care of the home land before we can start to worry about others. Somewhere along the line, that theory got lost in the White House.

            Taxes would go up because someone has to pay for it. England taxes gas to cover the Health Expense. From last I saw and its been a while, gas was nearly three times then what it is here.

            without profit, where is the incentive to come up with the next latest and greatest break though in Medicine? why would anyone pursue a cure for cancer if there was no money to be made off their efforts?

            Why they would not work hard? Why would they? They get paid the same as if they see three people a day as the ones that see 20 a day.

            We had a better mouse trap. It needed improvement like TORT Reform that was completely ignored.

            With the Govt paying the bills, you dont think they would be sticking their nose into your care???? Hell, he is sticking his nose in our bed rooms, infringing on religious freedoms, and digging his hand in my pocket so we can send or money over seas.

            Single Payer seems counter productive to a free market economy.

            FFA – I think some research would continue because medical schools are part of that equation. I don’t know if profit would be allowed for pharmaceutical companies, so they may or may not continue to do research.

            Many non-profit hospitals exist & thrive, so I don’t think taking profit out of hospitals is bad. Would it affect the supply of doctors? Maybe, if med school continues to be so expensive. What if med school became part of the healthcare system so that the tuition is subsidized somehow?

            I’m just rambling on a Friday morning, wondering if we could build a better system than other countries. That would be my dream solution, but I’m not convinced it is possible.

            I can give you one primary reason single payer is bad:

            Healthcare outcomes for catastrophic care.

            I showed you our survival rates. They are the highest in the world. Our system isn’t broken. Our lifestyles are.

            Our system has better outcomes than any other country, and higher survival rates. Don’t say it’s just those who can afford it who have the higher survival rates. It isn’t. I have also shown that when you adjust for our alarmingly high murder/vehicular death rates, our life expectancy is equal to every other country despite having an obesity rate that is 1/3rd that of most nations that have single payer. Our fat bastards are living as long as their healthy bastards, and more of our fat bastards have a high survival rate than their skinny bastards. It’s clear which system is better.

            When those with horrible conditions survive just as long here as those with pristine in other countries, it shows the other countries have better lifestyles but far worse systems.

        Yes Libby but those in favor of healthcare for everyone thought that they would be saving 2500.00 or more in premium, thought they were going to be able to keep their doctor, thought they could keep their healthcare plan if they liked it, did not know their deductibles would be 2,3 or 4 times higher than they were, did not know they would be subjected to a multitude of new taxes that will impact the middle class, did not know their personal information would be subjected to every hacker in the country because of a lousy, unsecured website etc, etc, etc.
        The rest of the obamacare lovers were looking for free healthcare paid for by the rest of us. Since 80% of those who signed up we’re Medicaid sign ups;looks like the free sh*tters are way ahead.
        In the meantime 6 million people lost their healthcare and the “best” this administration can come up with is 2.1 million sign ups which is a farce. They don’t know how many actually bought and paid and they counted anyone who applied and was approved.

            The way I look at it, The Obozocare officials say they need 7 million people (Not sure how they got to the number or if it was pulled out of the air. 6 million have lost their coverage. That makes the net number 13 million. They signed up 2.1 million (also a mushy number which can’t be varified). So, the net impact from this bad legislation is 10.9 million more sign ups needed, varified to be where the adminstration said they would.

            FFA – there is an article on IJ today that confirms people do not like the ACA, but are against repealing it without an alternate plan. The majority wants healthcare reform. Obama won both elections based on this fact. They don’t want the law repealed. They want it fixed.

            This new article says Repubs are finally realizing they need to come up with an alternative in order to get votes. Let’s see what they come up with. After all, the ACA was their plan to begin with and we see how that’s turned out.

      FFA, Gerald Ford was not in the White House for long, but I think he was an honorable man. The worst thing he did was pardon Tricky Dicky and that cost him against the wonderful peanut farmer we got as a result.           Good answer Libby. It might have been the right thing to do to heal the country and spare a trial etc, but politically, it was disastrous. Ford had no chance to win in the election after that pardon. Look at who beat him, a peanut farmer from Georgia with no clue as to how to govern. He was and is an embarassment to this country. I remember his little fireside chats where he had his cute little sweater on and saying we should just turn the thermostat down in the winter and wear more clothing. That was the extent of his energy policy. His other policies were equally disastrous. What a joke! It was a long 4 years until we got him out of there.

            Sargeant, all Puerto Rico has going for them is Tourism and Rum making and Chi Chi Rodriguez. Chi Chi came from humble beginnings and rose to be a star in professional golf.           China owns us. They are coming in and buying large properties. They had better watch out. Japan tried that many years ago when they were the big dogs and it backfired on them. They had to sell a bunch of real estate at a loss when they got in economic trouble and they are still in trouble.     Although I am glad that the IRS is delaying implementation of 105(h) anti-discrimination against non-highly compensated individuals, the IRS does seem to forge policy and not implement the law when:
    – the law says required reporting for employers 2014; changed to 2015
    – employer penalty 2014; changed to 2015
    – spouses are no longer dependents
    – 9.5% of household income is the max for the employee contribution per the law; IRS made up several options such as W2 to use instead of 9.5%
    Don’t get me wrong. It’s not just the IRS. The HHS list of ignored provisions of the law is much longer. the larger point is when Congress passes a law for good or ill, the Administration has the legal obligation to implement it, not to pick and choose and to delay implementation so that the Democrats won’t be shellacked in 2014. That is a corruption of our system of government.

      Huffington Post FFA? I am not surprised at Quizno’s. They can’t stay up with Subway and they have already closed down in my city. Penney’s got in trouble for catering to the gay crowd and they can’t attract the straight shoppers anymore so they are about gone. Red Lobster and Darden have been hurt by Obamacare and all the problems associated with it. Having said that, it will survive in one form or another. You can’t get through the door at ours because it is so crowded all the time and wait times are 20-30 minutes just about every night. They will do just fine and I don’t mind tipping for good service. These poor waiters/waitresses are trying to get by after having their hours cut due to Obamacare.

    Two new can you top this Obamacare stories- 1.) small business owner 11 employees. Deductibles tripled, and the monthly premium went from approximately 4,850 per month to 11,270. Per month. Additionally, The RX plan no longer pays for specialty drugs like Humira or methotrexate etc. he says he may have to let it go and send his employees go to the exchanges on their own.
    2.) A business owner we insured with 30 employees, sold his business. Made over 5 million net to him from the sale. He has a form of leukemia and his healthcare cost was somewhere north of 2000 per month (according to him). Once the sale closed he needed Heath insurance. He called the 800 line. He was asked “what his W2 wages were gong to be in 2014? He said- “I will not have W2 wages in 2014” They then asked- “so you won’be making a salary or be paid hourly?” He said no- his premium with leukemia? 232.00 per month. This guys net worth is in excess of 10 million dollars by a lot. Thank you Obama! He laughed and said I still would not vote for him.

    Sarge, they didnt ask the right question… He is going to have unearned income that is supposed to be taken into account on the subsidy. It may come in the form of an Annuity or interest income, but he is gong to get hammered on the 2015 Tax Return.

    This is a very good scenario of why this is not going to work. Its all Adverse Selection getting put on.

        KY, if you don’t deal with people in your job, you are lucky. Agents get chewed on every day of the week by customers for what is going on in our industry and with this terrible law. FFA gets it, I get it, Sargeant gets it. That is why we make the big bucks so we can take the heat. After the customer understands who did this to them, they understand and get off our back. And no, we aren’t racists for not liking this Progressive agenda and the ruination of a once great country.

            FFA, I was being a little sarcastic with my comment about us making the big bucks so we have to take the heat. I am glad I am 98% P&C so I don’t have to deal with this much. We, as Independent Agents are survivors in the marketplace. I have been at this a long time and have seen many ups and downs. I must say I have never seen a cycle like this. A bad economy and hard market wanting rate increases is tough to deal with. You and I have to look the customer in the eye and try to explain things and smooth the feathers. The employees on this site don’t have to do that and they will never understand it. They think it is easy and companies are so impersonal, they just ram things through and hope they stick. What a world we live in.

            Since OBama came to be, its been a struggle. I dont want to pack my family up and move, but now my wife is starting to put that pressure on me. I had a 35% jump in revenues last year…

            everyone in the forum knows my stand on Illinois, but yet I seemingly turned a corner last year. Even with Quinn screwing me out of over $500000 in premium volume, I still cranked it up…

            Agent – I may be an employee, but I have a book of business and have to look my clients in the eye at renewal and explain the same things you do. If I lose the account, it affects my pay. That’s why I approach every renewal as new business.

            You need to have more respect for employees. Without them you would have no business at all.

            Yes Libby, my expenses went up to the point it eat up all the increase in revenue.
            1) Health Insurance Cost was way up from 2012.
            2) I ramped up payroll expecting the Health Care to take off. Pay for training. Jump through all the hoops. ect… get NOTHING from it.
            3) moving the office.
            4) All other insurance was up. Comp BOP Umbrella.
            5) tech expense was way up. I ramped up security fearing that Obama and his web site was not properly secured.
            6) Phone & all other communication was up.
            7) Postage expense jumped way up
            8) Community Events expense was up.
            9) Taxxes were way up. Unemplyment Ins included.

            Taxxes and Health Insurance were the two biggest expense increase. And I have yet to sit down and disect everything.

            I work harder and harder and the Govt always finds a way to take it from me.

            So FFA, I am not surprised that Libby didn’t know about revenue and expenses since all she does is collect her check every two weeks. If she were cutting the checks out of the agency account on a regular basis, she might have a little more understanding. There is only so much in the till and we are dependent on commission income for our living. Some carriers have been cutting commission over the years. They seem to think we can do just fine on 10% for Auto. We used to get much higher commissions on HO, Inland Marine etc. Not so much anymore. The only answer is to put more business on the books to make it. The tax burden is enormous, particularly in the blue states. At least I live in Texas with no state income tax. I still don’t like my quarterlies I have to send to Obama so he can promptly waste it on his nefarious schemes.

            No customers, no income. A wise insurance man once told me that the customer may not always be right, but they are always the customer. An agent makes it by acquiring customers and then keeping them on the books. We have to listen to all their complaints and smooth the feathers down when they are upset with rate increases or what the government is doing to them. They are certainly right on that issue for the past 5 years.

            And you Libby should be respectful of your employer who took a chance when they hired you. Employers take the risks, put the money up, get the markets to appoint, pay the bills, put up with all the headaches, pay the taxes for self employment, employees wage taxes, provide benefits and most are also producers that bring the business in and then make a sale and bring the customers into the agency. We wear a lot more hats than you do and are responsible for profit and loss and the welfare of the agency. I wonder if your boss realizes how much time you play on IJ instead of doing your job.

            I hear you on the expenses FFA. We did not have one expense that wasn’t higher in 2013 than in 2012. We had good growth in income and it was eaten up with much higher expenses. We also had to do raises for employees and that is by far our biggest expense. They work well and are efficient, but the companies and all their changes, rate increases keep them hopping remarketing everything coming down the pike. This is a much harder business environment than just a few years ago. A lot of it has to do with what government is doing and the unpredictability with the market and what is going to happen in the near future. We had better hang onto our hat, because it is going to be a bumpy ride.

            Yes Agent. I ramped up payroll (70.91%)expecting things to pop. Seriously considering letting my service rep go and running just me and my producer.

            But the confusion sets in. One of my friends kids has inquired about being a producer. He is tired of traveling the country as a sales rep.

            Then my niece calls me inquiring the same… She a paralegal. Straight A Student out of NIU.

            When I broke independent, I had a goal of 5 producers on the payroll by then end of my 5th year.

            I generate the leads…. Just got a call back on a cold call that includes 12 commercial vechs, the GL, IM, Comp Umbrella….

            Maybe the growth spurt isnt over yet??? What the heck should I do? My wife wants to move out of state??? People calling agreeable to work straight up commission… Maybe I could be one of these power house brokers???

      I guess my point is that no one that is healthy has signed up that any of us in the Insurance Industry knows of.

      I am trying to get the ratio of Adverse Selection to the Young / health invincible.

      Everyone know that is the key. In my agency anyways, this thing will implode.

They go in to the doctor and their bill is $4,000 for the treatment and then they are told their deductible is $5,000. Sorry, would you like to pay cash? You don’t have an insurance claim here. The patient says, I thought I had insurance to pay for this. No, not until your deductible is met. Oops!

        FFA, do you not believe the numbers that were put out a week or so ago that 24% were the Millenials signing up? Since everything else this administration has proved to be a lie, I would doubt we have 24% of them signing up. It is overwhelmingly the older, sicker signing up and some of the applicants are the ones who lost coverage (6mil). Many are being sent to Medicaid instead of exchange policies.

            Hey FFA. I don’t know if you subscribe to Town Hall. They posted a story of the Aetna CEO, a guy named Bertolini that was interviewed by CNBC, hardly a bastion of Conservatism. Basically, he told them that Aetna may pull out of Obamacare because clearly the uninsured are not applying for coverage. The ones applying are people that were insured and then cancelled or the sick PreX and not the healthy uninsured. The risk pool is not being populated with who they said would benefit. He said the rates coming out in May will be double digit. Only 11% of applicants appear to be those firmly uninsured and that is not a proper risk pool. So what was the point of Obamacare/ ACA if it wasn’t going to bring rates down and pick up the uninsured? Did the President say the average family would save $2,500? Did he say if you like your plan, you could keep it, PERIOD? If Aetna pulls out, can Blue Cross, United be far behind? The implosion continues unabated.

            Wow Agent… We are not even through Jan, the first month. I suppose if the Govt Payment System would work properly and the carriers would get their money, Aetna may be willing to hang in there a little longer, but yep. If that is Aetnas experience, it cant be far off the other carriers.

            FFA, I saw an interesting article on how to create a Socialist State. The teaching is from Saul Alinsky on his “Rules for Radicals”. There are 8 levels of control that must be obtained before you create a Socialist State.
            1. Healthcare- Control Healthcare and you control the people.
            2. Poverty – Increase the poverty level as high as possible, poor people are easier to control and will not fight back if you provide them with entitlements.
            3. Debt – Increase the debt to an unsustainable level. That way you are able to increase taxes and this will produce more poverty.
            4. Gun Control – Remove the ability to defend themselves from the Government. That way you are able to create a police state.
            5. Welfare – Take control of every aspect of their lives (Food, Housing & Income).
            6. Education – Take control of what people read and listen to – take control of what children learn in school.
            7. Religion – Remove the belief in God from the Government and schools.
            8. Class Warfare – Divide the people into the wealthy and the poor. This will cause more discontent and will be easier to tax the wealthy with the support of the poor.

            Does any of this sound like what is happening to the United States right now? Do we know who the student of Alinsky is?

            Well FFA, we have been in this enrollment thing for nearly 4 months now and the carriers are seeing the fruit and the fruit is rotten. Of course, the law is also so flawed, it can’t possibly work for the carriers. These companies jumped on the bandwagon thinking it would be to their benefit. I am sure they were in awe meeting in the White House and being told they would make more money and would be insuring more people and charging more for coverage. The outrageous lies that had been told to the American People were repeated to them and then reality set in. Now, the bailout of companies looms as people aren’t enrolling or can’t figure out what to do or who to pay and they are upset with premiums which will continue to skyrocket. May increases in double digits. Can you see some of these people seeing another rate increase on top of the high premium they just signed up for? Stay tuned, it is now on fast forward toward implosion.

By the way, CSR’s can be replaced and none are so valuable they can’t be replaced. We have been lucky to have some good ones and currently have very good ones. We have had a few bad apples over the years who didn’t get their work done, liked to visit a lot and play on the internet. They are no longer with us for a good reason.       FFA, be careful in hiring Producers. We have tried several over the years. The problem with insurance is the lag time from when something is written and commission is received. Most producers want a salary against commission since they have to have an income to pay bills. We had some like that and they wore us out and never could generate enough income to offset salary. I have seen several industry articles that conclude that good producers don’t pay for themselves for the first 3 years. They often don’t have the drive to beat the bushes to bring it in. When I was a young producer many years ago, the agent was making a profit on me after one year because I was out there constantly bringing in business to write and building my book. Young people of today tend to want something handed to them like a book of business to fund them while they are learning. Larger agencies may be able to afford to do that and can play the waiting game for profitable business to be produced. Medium sized and smaller agents don’t have unlimited resources to fund these producers. I have been there, done that so I don’t see that as an option for us anymore. We have 4 producing partners and we like it that way and have established business and get nice referrals on our customers.

    I have inquiries every week. One of my Brokers had an employee lady that called me since they didn’t do Group there and asked about a Health quote. I sent her to Blue Cross as well. Hey, it will quote those Bronze, Silver & Platinum plans all day long and their site is much more secure. She can pick one of those sorry plans and decide if she can afford it or pay the fine for not. Her choice.
