    The resignation of Kathleen Sebelius is a loss for our country. Not only did Sebelius bring forth executive experience as previous Governor of Kansas, she also had a wealth of insurance experience, acquired during her 8 year term as the Kansas Commissioner of Insurance.

    Sadly, rather than entrust insurance issues to knowledgeable insurance professionals, the vocal Tea Party klan would rather delegate insurance related decisions to their heros, the highly trained Rush Limbaugh and Glen Beck.

      TEA Party (Taxed Enough Already)….very American. Strong belief in the U.S. Constitution, which protects the individual’s right to Life, Liberty and the Pursuit of Happiness. Committed to a strong government, yes, but one which is subject to limitations on it’s power, and is subservient to the citizenry.
      Incorrect/lying/ignorant/bigoted labels used in attempts to vilify and marginalize: “radical”, “extremist”, “bigoted”, or whatever other pejorative terms an un-American can come up with.

      COFFEE Party (Communism Over Freedom For Everyone Everywhere) a/k/a the Klueless Klan….very Un-American. Absolutely incompatible with the U.S. Constitution. Adherents claim they are not radical extremists, and claim they respect and uphold the U.S. Constitution, all the while seeking ways to undermine it and/or redefine it into something it never was – and never was intended to be.
      Characterized by endless lying, obfuscation of the truth, incoherent logic, and a strong reliance on ignorant and/or gullible people to promote and perpetuate it’s myth of “compassion and caring” and a “better”(?) life for it’s people – all subterfuge. Irrational obsession with the material wealth of others, actively promoting jealousy and envy, often the labeling the financially successful as greedy – unless it’s their own. No, “the people” aren’t really citizens in the democratic sense under this scheme, “the people” become merely subjects, part of the “collective”, cogs in a machine, to be manipulated and controlled by the ever-so-wise and oh-so-much-more-intelligent-than-you ruling politicians. Truly are extremist, radical and bigoted in their views, but are in a constant state of delusional denial.

            Libby, this was his flagship piece of legislation. This was basically the entire reason he got elected in the first place. The fact that it has been such a massive fumble negatively affecting the vast majority of Americans shows poor planning, major lack of oversight, and incompetency.

            The fact is the website launch was a fiasco. I hold Obama’s administration responsible for that.

            But the ACA itself is in infant stages and it’s too early to tell whether it will be successful or not.

            It’s funny, the battle cry from the right has been “No-one is signing up! They’ll never meet their goal!” But when $100k to $500k MORE people signed up than anticipated, all we hear are crickets.

          Hey FFA, This morning, there was an article published through Newsmax titled Republican Red States are the most free. It was researched and published by the Mercatus Center at George Mason University. The three basic categories examined were 1. Fiscal policy, including the tax burden, government spending and government debt, 2. Regulatory policy, including freedom from tort abuse, property rights protection, labor market freedom, Personal Freedom including gun control, alchohol freedom, marriage freedom, civil liberties, education policy and campaign finance freedom. Following is a list of states with the least freedom.
          1. New York- By far the least free. As a result, 9% of the residents based on the 2000 population on net have left for another state between 2000-2011, the highest such figure in the nation. New York has the highest taxes in the nation, 14%. Second is California, followed in order by New Jersey, Hawaii, Rhode Island, Illinois and Maryland. All of these states voted for Obama in 2012. Apparently, there are a lot of low information voters in these states and they like their nanny state benefits. The freest state is North Dakota, South Dakota, Tennessee, New Hampshire, Oklahoma, Idaho and Missouri. Among the larger Red States, Texas ranked 14th. Interesting article.

            Chicago had been crying about not getting their share of School Funding. Watching the Senators Face Book page, he states that after a comprehensive review, Chicago has got way more then they should have over the past several years. Now he is working on leveling the playing field. If he is successful at it, Chicago could look for higher taxes then what they currently have.

    Hey, I have a novel idea when it comes to public policy! Forget all the links to whatever-the-place (there’s good information out there, to be sure, but be very wary of the misinformation/disinformation highway) Get a copy of the U.S. Constitution (widely regarded as a work of genius, highly esteemed as the greatest creation of government in human history) and:

    1) Read it
    2) Comprehend it
    3) Retain it for reference

    After doing so, THEN decide for yourself whether what our government officials are up to is reasonable and/or legal.

    Not everything which is portrayed as good for you is really good for you…hence, the enumerated powers granted government by the people, limitations placed on that government’s authority, the bill of rights & amendments, etc, all contained in said document….just one example: in the interest of reducing crime rates, would you be willing to allow the search of your private residence, at any time, without notice, without any probable cause? Surely, allowing this would reduce crime?

    I’m hoping the readers will think for themselves, and then decide on all such issues, asking themselves “it might sound good, but is it right? Does it violate any of our other rights? Is it constitutional? What must we give up in order to get?”

      Well, Agent, our bastion of conservatism and a huge proponent of the Constitution proposed just that in another article. He said we should raid all the homes of suspected or known gang members, confiscate their weapons, and use ballistics tests (although he did not use that word since he doesn’t know it) and arrest them for any all crimes connected with said firearms.

      Just what, EXACTLY, is unconstitutional about the ACA? And please. Be specific.

        Hi Libby,

        One justification that was used is the commerce clause, which reads: “To REGULATE [emphasis added] commerce with foreign nations, and among the several States, and with the Indian tribes”. Now, it seems obvious that REGULATE does not equate with being forced to PARTICIPATE.

        Logic also dictates that being forced to pay (a premium or a fine) in order to remain a citizen in good standing can’t be right, and, in fact, has already been declared unconstitutional. Many years ago there was a “poll tax”, which a citizen had to pay in order to vote. There was also at one time a requirement that only property owners could vote. Both of these have long since been declared unconstitutional by the Supreme Court, and as heretofore stated, that owning property or having money IS NOT, AND CANNOT BE REQUIRED to be a citizen in good standing.

        Another justification was the taxing power. By it’s very definition means that you must first OWN something (property or money) in order to owe a tax, which brings us right back to the previous point. Taxing/fining someone simply for being alive is in reality tantamount to a “poll tax”.

        So, I hope this clears up just EXACTLY what’s wrong with this law.

        As to your other point regarding raiding homes, I raised the question of trading liberty for safety to make the point that most sane, rational citizens would recoil in horror at the thought of warrantless searches, without probable cause, in spite of the fact that somebody might try to make the case that it would be “good” for us…just making the point that just because something might be portrayed as yielding a “good result” doesn’t make it right, or even “good” in the long run.

        One question for you, Libby: You have yourself stated that you work so efficiently and smartly that you can blog all day and still get your work done. I can’t seem to accomplish that feat, so if you make $60 and I make $20, should you give me $20 so as to make us both receive $40? Some might say that it would be good, but would it be right? I know many liberals would think so, but I don’t. I say “you found a better way, you earned it, it’s yours”.

        One last question for anyone who might know: It has been said that our sitting President is a Constitutional scholar, but does anyone know what country? I think it’s the USSA, but I’m not sure.

          JB – Your question to me seems to infer that I am a socialist. I am not. I do not begrudge someone making more money than me, as long as they work honestly for it. The raping and pillaging of the American people done by Wall Street and big business does not qualify.

          Regarding the issue of whether this is a “poll” tax and thus unconstitutional, the Constitution allows for “capitation” or head taxes. Just because the ACA “head tax” relies on whether one possesses or does not possess health insurance does not in and of itself make it unconstitutional. It is still applied to every American in the same way.

          By the way, I have SCOTUS on my side. I think they may know a little more about Constitutional law than we do.

            “The Congress shall have power to lay and collect taxes, duties, imposts and excises, to pay the debts (etc)…”

            Can’t find “capitation” or head tax in the Constitution, nor does the definition of those items that are listed use any such terms, but I guess it depends on what your definition of “is” is.

            And no, I didn’t mean to imply you personally were/are a socialist – I didn’t use that term, I used the word liberal – I said “many liberals…” Are you implying that “liberal” is synonymous with “socialist”? And I said nothing about Wall St, but you are right on target with the honesty aspect – dishonesty should never be rewarded, wherever it is.

            And lastly, food for thought: just because something may be deemed “Constitutional” doesn’t automatically mean it should be enacted. Many proposals may pass the “Constitutional” test, but still may not be practical or desirable. (BTW, in case you didn’t know, occasionally previous SJC decisions are overturned)

            I certainly have no interest in being confrontational with you or anyone else. My only goal is to try to get people get their information from the true source of our nation’s “rules of the game”, the U.S.Constitution, and to then decide for themselves whether whatever is proposed/enacted comports with it.

            I may not always agree with your take, but I do appreciate your interest and input.

            I am not being confrontational with you, although that seems to be everyone’s reaction when I debate or ask questions. Sorry, I don’t just go along to get along with the majority on this site.

            Check the Sixteenth Amendment:

            Article I, Section 9, Clause 4:

            No Capitation, or other direct, Tax shall be laid, unless in proportion to the Census or Enumeration herein before directed to be taken.

            Capitation is used in the Constitution.

            And no, I don’t equate Liberal with Socialist, but taking from one person to “equal” distribution to another sure sounds socialist to me.

            I pay the same taxes as every other working American. Why shouldn’t I be able to voice where I want some of mine to go? I want some of my share to go for providing healthcare for all Americans. Is that liberal/socialist? I want some more of my share to go to feed hungry children. Is that liberal/socialist?

            Remember, the Constitution provides for taxation for defense of the nation and provide for the general welfare of the citizens. I do not see anything contradictory with the goals of the ACA and Constitution.

            Lastly, “just because something may be deemed “Constitutional” doesn’t automatically mean it should be enacted.” is a true statement. However, it was enacted and it was enacted within the laws outlined by the Constitution.

    Hi Libby,

    Mea Culpa! You are correct, the section you cited is under “Powers Denied to Federal Government”, and does in fact use the term “capitation”, but as you accurately quoted: “NO [emphasis added] capitation or other direct tax shall be laid, UNLESS [emphasis added]in proportion to the census or enumeration hereinbefore directed to be taken.”, which seems clear enough to conclude that any tax NOT in proportion to the census (i.e., per head) is un-Constitutional. If the ACA tax is tied to failure to have health insurance and/or is tied to a percentage of income, would this tax be un-Constitutional? I would say so, but then again, I’m only asking.

    I lean, admittedly, to the conservative side (root “conserve”, as in conserving the monies in the public treasury)and I do agree that many social programs are absolutely Constitutional – just because someone is a “conservative” does not mean that they are automatically against giving assistance from the public treasury to the TRULY NEEDY (which is a myth many on the left are fond of perpetrating and perpetuating) and under our current programs some of your share DOES go to provide assistance to our needy fellow citizens.

    Perhaps more could go to the truly needy if less were squandered on those who are NOT truly needy. The public treasury is finite, and wasteful spending, fraud, failure of government to carefully exercise their fiduciary responsibility (etc, etc) results in LESS being available for those citizens who truly need help – which many of us believe is the natural result of liberal SPENDING policies. If we want to give more to NEEDY we have to give less to GREEDY.

    Socialism necessarily requires the individual to “obey, comply and submit” to the central planners – not compatible with the U.S. Constitution – but I wasn’t trying to label you as that.

    As for for the ACA’s enactment, it was passed entirely on a partisan vote, through what many would call dubious circumstances, without being fully understood, which is probably the reason it didn’t have a lot of popular support (pass it to see what’s in it sounded a little backward to me) and then upheld by a very thin 5-4 SJC decision. Oh well, I understand that very little legislation is unanimously supported, and I understand your point, and your are technically correct, however…many of us are left wondering whether there could have been a better/bi-partisan/popular way to fund the healthcare/health insurance of the uninsured/pre-x, etc…oh well, I guess we’ll never know…

    Anyway, Libby, this is probably going to be my last post for awhile (I just don’t blog very often) and as I previously posted, although we don’t agree much of the time, I do appreciate your interest, input, respect your views and enjoy the lively and robust debate!
