Winning was not the point. Local government has a duty to be proactive in keeping the members of their community safe. Sitting back and letting insurers do all the work is unacceptable. They charge taxes for a reason and I am sure many pockets are lined before levees are repaired or potholes are filled… no money left over for sandbags.
This sounds about right for Chicagoland. They are Progressive, in debt for about everything and no money to do the right thing on sewers or other facilities.
Angie, I live in an area where that is exactly what happened. I was new to this community and bought a house in a new neighborhood. The local government allowed 250 new houses without any adjustment to the sewer system. We flooded during heavy rain and lost thousands on our homes and cars. Sewer backup was covered by some (mine) and many just paid for it out of pocket. Once the city was looking at a class action, they fixed the problem.
My Community was named in the suit. Money is very tight in this neck of the woods. No resident will vote the powers that be more money especially after the fiasco with our electric. Air Conditioning not even running yet and already have a bill $287.00 because of the dumb a$# arrangement with Prairie State Power Plant. We are stuck for 21 more years and being told to expect a 60 – 80% jump in rates. This tax payer will not vote to give them idiots one more penny.
So, Farmers has the option to charge proper premium for Sewer Back up or get out of Illinois.

Farmers a many other carriers have offered the optional sewer & drain backup coverage for years. Rising waters sounds more like a flood issue.

Even if they won, the munis would likely have flooded the courts with appeals.
