Drugmaker Roche Wins Reversal in Accutane Duty to Warn Case

    It always seems to be someone else’s fault and drug makers seem to catch a lot of blame no matter what. When they advertise, they have a list of side effects as long as an arm. The doctor should also advise of side effects. Then, if something goes wrong, the patient blames the drug maker. What a scam.

      I disagree that the drug manufacturer shouldn’t be held liable. The doctor cannot be held liable for prescribing a drug as I’m sure IBD was not listed as a side affect. If it was, then so be it. Since the drug caused something that the drug manufacturer should have caught during testing, then they should be held responsible. In a trillon dollar industry I think they can afford to pay when they screw up.
      If this was truly the case, then auto manufacturers should be immune from suits and the salesman should have to defend selling a car that ended up having a defect.

    Hey Agent, Obviously you know nothing about the history of Accutane. HoffmanLaRoche, before releasing the drug, found cases of inflammatory bowel disease (IBD) in their studies around 1975 or 1976 I believe. The company hid these results from the public and put the drug on the market. Early on, there were no warnings to patients about IBD until the late 1980’s/early 1990’s I believe. A recent study from a major university demonstrated that people who took Accutane, have a 4 times greater chance of getting IBD than the general population. In New Jersey, there are approximately 7,500 pending lawsuits against LaRoche. They were only able to win in the Appellete Court because of legal technicality. Before you start throwing out general statements, you may want to do a little research before call this a “scam”. Tell the plaintiffs about this scam – they had to undergo colon removals, have an ostomy or go on medications to save there life.

      Obviously Biddy, I am not a medical researcher like you and don’t claim to be, but as a consumer, I give pause when a drug lists 20 something side effects and then they say to consult a doctor before taking it. By the way, who do they test these drugs on? Perhaps Liberal bloggers would be a good start.
