    I’d like to know what the current figure is on the ‘loan’ made to COOPs. This article doesn’t have the number, which has been elusive; i.e. I’ve seen several figures from several sources; e.g. $3.4B, $2.4B, etc. It’s a moving number, based on what people include and when it is evaluated.

    Since the ‘loans’ may not be repaid by COOPs which have already failed, it might be difficult to give one number to describe the amount paid in subsidies on an unconstitutional basis.

    This ruling means The ACA must ‘stand on its own’… i.e. much higher rate increases for some.

    A little over a year ago, US Rep Paul Ryan, R-WI, questioned the US Treasury as to the reason they made over $3B in payments to COOPs or Health Insurance exchanges WITHOUT APPROVAL of Congress. The UST never replied. Hence, this lawsuit.

    The Death Spiral continues to drag down The ACA. This time, the subsidies will end, further increasing costs and making coverage MORE UN-AVAILABLE than it was before.

    More woes….. Had a guy call this AM. They took away his subsidies because he didnt send then 2015 Tax filing in Early Feb when he had authorized The Market Place to communicate with the IRS for this very form.

    I called my Market Place dental Carrier this Am as I was balancing my check book and didnt see April Payment Cleared. Turns out they didnt get it and my policy lapsed April 1st. I had already sent my May Payment in so I wanted to give them a check by phone. They referred me to the market place which told me it would take 30 days to get a response from the carrier.

    oBama has really messed up the system beyond repair and has screwed numerous people. This is proof that the Govt is incapable of handling Health Insurance and just needs to but out.

      I signed up with my wife in one state. Several months later we moved, and after untold attempts to change our address, the Market Place finally told us we had to apply again. Weeks later, we were declined.

      Occasionally they would call to ask us to apply AGAIN, so I told them to NEVER contact us again.

    News-Flash, Mr. Not-Earnest, it is not the executive branches right or responsibility to INTERPRET a statute. That is the judicial branches role. This has been the problem with Obama and this administration. They try to interpret the laws and change them with a flick of the pen and the role they are supposed to be responsible for, UPHOLDING the laws, they forsake.

    Obama is a lawless dictator and Hilliary is trying to follow in his footsteps.

    How can you progressives possibly support the blatant deceit, dishonesty and disregard for the rule of law??? The entitled do it because they are slaves to the support they get from the govt.

      Uhh, The Supereme Court already interpreted the statute. Mr. Earnest is referring to their ruling. And, which one is it? Is President Obama a dictator or a spineless empty suit puppet? You can’t have it both ways.

        Uhh, Planet, the way it is suppose to work is Congress makes the laws, the judicial branch interprets the law and the executive branch upholds the law. Earnest’s statement in the article clearly complained that the suit was how the executive branch was interpreting the law.

        Another news flash, Congress also has the power to spend the money. They can choose what to fund and not fund, not the executive branch. Soooo…who is now trying to reinterpret the Constitution???

            Let me get this straight, the debt and deficits that accumulated during President Obama’s term are his fault, but the debt and deficits that accumulated under past presidents are not their fault? Do you credit President Clinton for the surpluses in the late 1990s?

            Please tell me again how he is not treated differently than past presidents who had similar and sometimes worse results?

    No, Celtica, it’s not time yet.

    But a week or two BEFORE the RNC Convention, their plan will be published. Putting it out now will only give the Dems and their liberal media cohorts time to divert attention from the Convention onto the new plan. I have insight into it because I’ve listened to what problems have been repeatedly pointed to by the R members of Congress who are working on that issue. There is a common theme of their complaints. that means it will be fixed in the replacement approach. Just my opinion, FWIW.

            A. There will never be a system that works for ALL citizens. It doesn’t exist today in the Socialist countries that have gov’t run/single payer systems. Balancing affordability with quality and accessibility of care is key. The bottom line, the previous system was better AND more affordable for the majority of the country.

            A. Yes, I agree that improvements can be made.

            A. No. The private sector is still constricted by gov’t oversight with regards to interstate laws and the tort system. Fraud (patient and provider) is also rampant. I think we should start with those changes first because, in theory, that should help lower costs.

      You have been fooled into thinking the Republicans have any real interest in health care reform. If their plan would be so great, where was it from 2003-07 when they control of all 3 branches? Why have they not put their plan in writing in the form of a law the past 12+ months since they gained control of Congress? They have no problem passing bill after bill repealing the PPACA, which had 0% chance of becoming law, but where is the replacement?

        Even with its flaws, our healthcare system worked for 90% of the population during those years. The other 10% had Medicare as a backstop.

        Please try to admit that the govt can not run ANYTHING more efficiently than the private sector. If they do, please name one. Everything they touch costs more money and becomes less efficient.

        The best plan the Repubs can come up with is to get out of the healthcare business and get out of the way. I’ll admit that modest oversight is necessary to keep the private sector honest, but, they should put in laws to promote competition, not stifle it.

          With all due respect, if the healthcare system had been working for 90% of the population the ACA would not have been drafted and/or passed. The ACA’s attempt to include gov’t mandates while trying to retain some semblance of free enterprise is why it’s failed. It’s interesting how we want healthcare to be innovative & efficient and managed by profitable entities, all hallmarks of the free enterprise system, yet we expect and demand the system to treat every patient (or customer) exactly the same way with respect to treatment & drug availability. Regardless of their ability to pay. That’s not really how the free enterprise system works and we can’t come to an agreement because we can’t have it both ways.

            Why do tens of millions of working American citizens have to suffer while waiting for the Republicans to be presented with the optimal time to reveal their brilliant plan? What is more important, the health and well being of American citizens or political expediency?

            I am sick and tired of Republicans getting a pass on putting their grand health care reform plan in writing because it would be vetoed by President Obama. That did not stop them from passing 30+ bills to repeal the law that were going to be vetoed. Until you are willing to hold your own party accountable for their failures, you have no credibility.

            It WAS NOT and still IS NOT ANY Gummint’s responsibility to provide affordable healthcare to citizens. So, you are arguing on a false premise, which I won’t allow you to use.

            The ‘Free Market’ can be coerced into providing a needed product or service IF the Gummint gets out of the way or doesn’t interfere at the outset. Unfortunately, Medicare and Medicaid created distorting interference with health insurance market forces. Thanks, LBJ, …. for nothing!

            IF ‘enough’ people don’t have healthcare insurance, the most innovative, resourceful, and wise members of the industry would be compelled to determine ways to lower costs.

            I never said it is the government’s responsibility to provide health care. What I said was that the private sector/free market has had decades to provide solutions and failed.

            Is it your position that the government should be removed from health care (Medicaid, Medicare, VA, and regulation) completely? If so, where do all of those “undesirable” risks go for affordable coverage?

        For those who keep clamoring for the Republicans Plan…. its’ release is being timed so that it will be considered BEFORE the 2016 election. But it won’t be introduced before Obama leaves office because he would just veto it out of pride and his inability to admit failure.

        It will be introduced so American voters can see how a better plan would work….. rather than “wait until we pass it so we can find out what’s in it.” -Nancy Pelosi. Any problems that are pointed out by members of Congress can be fixed before it will be introduced in 2017.

          I have been asking this question for years and cannot get a straight answer from any:

          If they will not pass a bill to provide a replacement of the PPACA because it will be vetoed, why have they passed 30+ bills to repeal it knowing that each would be vetoed?

          My answer is, they have no interest in governing and just want to annoy the president out of spite. Very grown up of them.

          A couple interesting points regarding this article.

          1. “Someone who repeals (ObamaCare) is left with nothing,”. So a Republican has finally admitted that Senate Democrats (prior to 2015) and President Obama were looking out for the American people when they were stopping the efforts to repeal.

          2. The “The World’s Greatest Health Care Bill. Ever.”, as presented by 2 Republicans, does not repeal the PPACA. Another admission from Republicans that the existing law must have some benefits and is not as damaging as they have been espousing for 6 years.

            Republicans in Congress want to establish a Democrat voting / veto record to use in the 2016 Election campaign against Clinton, who will support continuation of the ACA.

            Further, continuing their repeals of the ACA is a tactic by Republicans to establish proof of Einstein’s ‘Theory of Insanity’; i.e. his definition of insanity is, paraphrased; repeating a failed process hoping for a different outcome.

            Lest you think the ‘failed process’ is a repeal vote, consider how large a failure The ACA is, currently, and in the near future (November) when an 18% increase in renewal prices is projected.

            Now, consider the effect of reporting to American voters in September and October leading up to the General Election that Republican controlled Congress attempted to repeal ACA multiple times, and multiple times Obama vetoed it so that Americans would be forced to endure its problems and higher prices. Voila! Republican majority in Congress is virtually assured for another 2 years or more, until ACA is repealed and replaced with something akin to the Sessions Plan noted in my recent posts with links to such.

            To your point about ACA not being as damaging as has been espoused;

            repeal without a replacement in place would cause calamity, so a slow replacement is suggested. We will know more soon. But, I expect the Republican’s Bill about to be revealed will go through an evolutionary process that improves it, using input from the Health Care and Health Insurance industry. Think of it as a work in progress Bill, to be amended before a vote…. unlike Nancy Pelosi Galore’s approach of first passing a catastrophically flawed bill to ‘find out what’s in it’.

            The ACA won’t need to be ENTIRELY repealed. What remains after partial repeal will eventually be replaced over time.

            Watch and learn.

            Are you saying that the Republicans have been wasting their time and taxpayer money to set up their campaign strategies? Interesting way of governing. This is exactly why I have trouble supporting Republicans recently.

            I did not say that the PPACA was not as damaging as has been espoused. I was using critical thinking to state the Republicans who have crafted this great health care reform bill to be released.

            Are you even aware of the full context of Representative Pelosi’s statement or do you prefer to just regurgitate false Republican talking points? Do you even know the process of how a bill goes back and forth between the House and the Senate before it goes to the president’s desk? If you are genuinely interested in learning I would be happy to educate you.
