    This story is eerily similar to John Grisham’s novel, The Appeal. A large corporation backs the candidacy of a judge (under the table of course) in order to overthrow a large court settlement. Since the book came out in 2012, maybe Mr. Grisham used State Farm as his example!

    This is funny on so many levels, not the least of which is the fact that the pitchfork carrying consumers ranting to allow the class action suit to proceed haven’t figured out yet that they are only necessary so the law firm representing the class can get very rich, while the actual plaintiffs will all receive some pittance that would barely pay for a diet Dr. Pepper.
    Also, I would have to think that proving intent will be extremely difficult as I doubt that SF left any written correspondence floating around the ‘cloud’ outlining their nefarious plan with the judge in question. Just another case of legalized extortion. My guess is that there is enough at stake here to cause SF to see this through, rather than settle it. I hope so.

      If SF loses and there seems to be a good case here, it is likely to be one of those treble damages awards and that might get into the bottom line pretty good.

      Some years ago, SF got into trouble in Texas by overcharging customers and was ordered to refund by the TDI. They protested, declined to refund and fought it for several years. Even a judge ordered them to refund and they ignored that as well. In the end, they reached a settlement of sorts and refunded several hundred million dollars. They were not the good neighbor in that scenario.

      You seem to think there is no value in class action suits as a mechanism for punishing bad actors when it would be too expensive for an individual to bring forward a suit. Individual responsibly, unless it on any way keeps a company from making any extra money-nice philosophy.

    Hey Jax,

    Better the poor pitchforks carrying (Paying Customers) of Sate farm get a dollar, and the class action firm get millions, than to allow SF to benefit from its improper conduct. SF should be fined the 1 billion and as far as Im concerned after paying attys and ripped off customers, the balance can go to charity. The judge should be impeached for not recusing himself from any SF cases after taking money from them. Unfortunately, this is not the only case where ins co has either targeted a judge in election they didn’t like, and tried to get judges elected they did like.

      Robert: Umm, you sure about that ? How much do you really know about this case and exactly how were ‘millions’ ripped off ? I don’t buy into the media or class action atty bs. For what it’s worth, a billion dollars is a lot of money. Like more than you could get in your car. That, in and of itself, is really funny to me.

    Look for State Farm to appeal and the fairly conservative U.S. 7th Circuit to very possibly toss this case. They couldn’t move interlocutory before, but with this ruling they can and the 7th Circuit may well agree to hear arguments on other rulings (motion to dismiss) while they are reviewing the Rule 23 issues. This is not a viable cause of action (some policyholders claiming damages while others likely benefited?) and will be ultimately dismissed, even if it does not occur until a Rule 56 summary judgment. My opinions, yours may differ.

    State Farm makes me give my mileage on my car every 6 months. It is to lower my payments driving under 7,000 miles a year. Instead they keep raising my policy. I should have 1. discount for low mileage 2. discount for no ticket or accidents in over 30 years. 3. They are lying about everything or info they collect on all of us. They are selling our private info for money & they do not going to give us a discount this is deceptive unlawful info collection & is against the law. They should be sued for false info collection.

    I was struck by a driver that ran a stop sign. State Farm said that it is partially my fault for being in the cross walk when the driver ran the stop sign. State Farm is stupid. They will only loose this in court and cost them more money. This is why people with state farm keep seeing their insurance premiums rise. Instead of admitting fault when they it has occurred and settling out of court they go all in which significantly raises their costs which they pass onto their consumers.
