Let’s all hope that his comments at the parole hearing are true, and he gets some paying work and pays towards his court mandated debt. If it is true that he will be getting a $20k monthly pension and social security, he will have plenty of money to live on.
The one thing that upsets me about our legal system is how an individual can be found not guilty of a crime in criminal court yet be found guilty in a civil court! Not saying he did or did not commit murder but how can one be liable civilly but not criminally? Any legal experts on here to explain that to me?
Hello Wyoming. I am DEFINITELY not an expert but I believe the difference had to do with the fact that the criminal case was for murder while the civil case was for wrongful death. In the criminal case, you have to prove that someone did it beyond any reasonable doubt (>99% certainty). In the civil case, you only have to prove that someone did it based on the “preponderance of evidence” (>50% certainty).
Civil cases in general are much harder to defend against because a lot of them can be won in this way. The trade-off is that the punishments are generally just cash awards or other forms of restitution.
Exactly. The difference between beyond a “reasonable doubt” which is probably between 80%-99% depending on who you ask and a preponderance of evidence which is anything over 50%.
The reason for the difference is that in our legal system we want to do all that is possible for falsely imprisoning an innocent person. But in a civil case we just want to make all parties whole. That doesn’t require absolute proof, just what is more likely or not.
Just thinking about how the lawyers can possibly protect the Goldman’s interest in the judgment, I wonder if it would be possible to sue Simpson to take possession of, including all rights, title and interest from “this day forward” in the “name” O.J Simpson now or as hereinafter constituted, by or on behalf of Orenthal James Simpson a/k/a O.J Simpson. If anything, that is the only asset available to him or anyone else looking to profit in the future…
As I read this, the author mixes up protecting existing assets with protecting future income. OJ has pretty much succeeded in protecting all the existing assets he still has left including his pension and if he still had a home. The Goldman’s will have a difficult time squeezing anymore blood out of that rock. But as far as future income, that’s all game. All of it. The article refers to be able to garnish only 25% of income. Well they can’t even garnish 1% of his retirement income. He gets to keep 100% of that. But every penny he makes in addition to that in my mind belongs 100% in the Goldman’s pocket. He gets to keep his existing income, all of it. But the Goldman’s should be able to get 100% of anything else. I’m sure OJ can “get by” on $25,000 per month. And even have some money left over to continue his search for Ron and Nicole’s killer(s).

The relationship was already hated by the convert population of the public that thought this man had too much of a good life. That civil case was genius, that fact that he was proven innocent (or the state thought they could prove beyond the shadow of reasonable doubt) and still “those families” didn’t care, they wanted his money! The money initially that would compensate for their little princess girl (which she was not) being with a BM. “Hell, at least he’s rich, she’ll receive that in due time.” It didn’t work and some racist cop carried out a murder and they found a scapegoat in OJ. You know how WM are with a woman, they can’t stand what they can’t control. Leave the man alone. The more you talk about this man or his money in a neg. way shows the world how you are still hurting because something on the inside is affecting you. Focus on other things.
I imagine his past and current legal bills will eat up his pension for years. I don;t feel sorry for him and still remember, as a youth, the 70’s commercials where he jumped over a couch or banister or something in an airport. He had the world by the tail and lost it due to his fault.
OJ’s lawyers will receive more money than the Goldmans. That’s just the way the system is at this time. OJ reportedly gets #30,000 a month from various judgement proof sources. It’s what he does with it that will determine any payment to the Goldmans. Remember CNA Insurance Company PAID for his Civil defense with a cap of $2,000,000 and a contractural agreement NOT to sue for bad faith. What a double standard!!

Jack, as I recall, OJ did not lose his NFL pension despite being in prison. Wonder where that money is or did the kids get it and spend it?
