Falling Trees: Act of God or Covered Event?

    “act of god” is not an insurance term and I defy anyone to produce and insurance policy that uses it. it is a term made up by attorney’s and courts and has no place in discussing insurance.

      And yet..insurance companies use “act of god” to deny subrogation claims all the time.

    go look at case law – for trees it’s the condition of the tree with a higher standard of care for trees in urban areas vs rural. If the neighbor’s tree is in poor condition and falls on you home you may well have a case vs his liability policy. If it’s a normal tree and falls on you home in a storm you probably have to look to your property policy for coverage.

    More fodder for the courts…..maybe we need a “no fault” law for trees, large shrubs and bushes.

    If lightning destroys a tree, wil homeowner’s insurance pay for $1,800 cost of removal od tree?

    My neighbor reported that my tree fell on his property an Act of God. He reported the incident to his insurance who I believe compensated him for the damages. He request for me to pay to have the damage limbs remove from his property. Is this fair even thought he filed a claim to is insurance and was comkpensated for the damage.
    I find this action to be fraudulent

    Question? A dead tree on my property fell on neighbors fence during a storm causing slight damage. The storm happened April 20, 2015. I received a phone call from the neighbor today May 8,2015, asking me if I had received a letter from them requesting that I pay them $80.50 for damage caused by the tree. I did not see any such letter. If I had known about the tree falling and the fence needing repairs, I would have been there fixing the fence. They have my phone #, she called me and I answered her right away. They are threatening taking me to court to pay the $80.50. Shouldn’t I have had the opportunity to fix the fence?

    A wooden parcel of property (rural) newly purchased by out of area buyers where a tree fell over onto a county road and a truck ran into the tree causing damage and injuries, is the property owner liable

    wind storm came through Canton Ohio lifting a very large tree out of the ground, destroyed my yard, twisting other trees in the yard, wiping willow twisted and split in the center, we called the insurance and was told that was an ACT OF GOD, what do we pay insurance for? I thought it was for unseen problems, why do they do this to people not only are you already up set with what’s happed now you can’t get any help to get it back in order.

    Question for you = hurricane Irma caused back porch of neighbor’s house to break apart and fly over their house causing damage to my residence. Who is responsible for paying the ‘deductible’ insurance due to this ??
