Florida Legislature Passes Medical Malpractice Changes

    There needs to be more reform on expert witnesses for medical malpractice insurance claims. It is amazing how both sides can hire a doctor and get them to testify however they want to testify. (see http://www.equotemd.com/blog )Doesn’t it seem like there should be multiple opinions on a claim instead of just someone that is getting paid by the lawyers asking them to testify for them? What is the point of expert witnesses if both sides have them and the jury has no idea who to believe since the jury members are not doctors.

    This is a step in the right direction. In order to implement a common sense practical solution to malpractice insurance physicians need to be assured that spurious litigation cannot hang over their heads while providing quality care to their patients. Making sure only genuine expert witness are used will hopefully help address the issue of meaningless lawsuits brought against doctors in Florida.

    It is important to have caps and tort reform, but we also have to have mechanisms to punish providers who have acted reckless. Also we need to make patients whole for their actual damages. As a malpractice insurance provider we have to be mindful of this.
