New Tennessee Workers’ Comp Exemption Law Takes Effect

    Work comp within the TN construction industry is DEAD. This is a BOOM for small bussiness (5 “Parnters/Officers/Onwers”) all EXEMPTABLE. 5 exempted business owners can do a LOT of construction work. Let’s say I’m a ROOFING CONTRACTOR and I employ 10 or 15 Tenn’s… My smaller competitors do not have the BIG FINANCIAL BURDEN of PAYING PREMIUM FOR STATE IMPOSED WORK COMP. Why is my BIGER BUSINESS (EMPLOYING MORE TN CITIZENS well protected if injured) STRAPPED WITH WORK COMP COSTS?

    FURTHERMORE: SOLE PROPRIETORS EXEMPTABLE FROM WORK COMP?
    I think I’m going to make all of my “employees” get business cards and a ficticious names to start their own SOLE PROPRIETORSHIPS and SUBCONTRACT my roofing work to them so I don’t have to pay for work comp premium on employees. If they don’t have GL, that’s ok as my GL will extend to “uninsured sub’s. I’m paying the same GL RATE as if they were “direct employees”… This is the only way I (or any REAL EMPLOYER in construction) will be able to compete in TN. I’ll become a ROOFING istallation/repair BROKER.

    But, what if one of those EXEMPTED “business owners” really get’s hurt. If they don’t have WC, they probably don’t have health insurance, if so great, but DISABILITY? Most likely not. I see even more HEALTH CARE and SOCIAL SECURITY DISABLITY costs… SHIFTED either to those that are still DUMB enough to be paying for Health Insurance or to the TAX PAYERS of the state of TN.

    My real question is: Who’s TCB in TN?

      So one guy can’t be a business is what you are saying? Is this so you can continue to abuse workers for $8.00 an hour? Live and let live for goodness sake!
