This really could create a lot of issues for privately owned buildings in urban, high crime areas. I hate to see innocent people killed but with this settlement what will be the new standard for the future. Exactly what determines the amount and type of security needed?

I agree. Since the landlord was the only person with any sort of insurance coverage, they went after his policy. Will the Florida legislature now require at least $1 million in liability coverage for all properties?

Exactly. I am sure that this will cause many issues. Besides, how about suing the police force for not making their presence known in this “crime-ridden apartment complex ” It makes the same amount of sense.

How is an apartment owner legally liable for the actions of an unrelated third party? Security measures may reduce the impact of crime, but they certainly won’t stop crime from occurring. I sure hope at least some of that settlement is used for the direct benefit of the twins — perhaps a move to a safer neighborhood, a college fund or annuity??

where is the personal responsibility for choosing to live in this area? Oh I forgot, since the plaintiff’s attorneys starting running roughshod over everyone there is no longer such a thing.

confused… it states that she was sitting outside of the apartment complex… so was she on the sidewalk? if so, then the property of the sidewalk belongs to the city! now, if they are truly going to say that this was a crime ridden area, are we now going to have landlords be responsible for all security in these areas? now, if i remember, there was another article about grocery store, where in the parking lot, someone got shot… they filed a claim against the store for the exact same thing, but they did not get anything from the judge. so? um… the city is just as responsible if it is crime ridden…
