San Diego County Superior Court Judge David Danielson has sentenced Del Mar businessman Kevin Vint, 50, to three years formal probation for conspiracy to commit workers’ compensation insurance fraud and payroll tax evasion. Judge Danielson ordered Vint to pay restitution of $119,000 to State Compensation Insurance Fund and $31,000 to the California Employment Development Department.
Vint is the owner of Kevin Vint Masonry, a business specializing in residential homes and commercial projects in the San Diego area. The business has been insured with State Compensation Insurance Fund since August of 2000.
In 2003, a Vint employee sustained a back injury at a project for Santa Fe Christian School and filed a claim. During the claims investigation, it was reportedly discovered that the injured employee’s salary had been paid in cash. This was discovered when an audit of Vint’s records could not find evidence of wages paid to the employee. State Fund’s Fraud Investigation Unit forwarded its findings to the San Diego County District Attorney’s Office.
The DA’s Insurance Fraud Division investigated and reportedly discovered Vint had paid employees nearly $400,000 in cash wages to avoid paying workers’ comp premiums and payroll taxes.
On Feb. 17, 2005, a grand jury indicted Vint for conspiracy to commit insurance fraud and payroll tax evasion and on Aug. 11, 2005 Vint was convicted.
