    Since Governmental Action is excluded from the policy, it really doesn’t matter if he told the Insurance company or not. It would be denied either way. They are the ones that leased it out. Not sure why the government raided it anyway if it was considered “legal,” but that is beside the point.

      It’s not legal to the federal government, but is protected under Montana state law.

    i f they have legal standing,can’t they file a claim against the gov.isn’t that what the insurer would do?

    This looks like a case of states rights vs. federal gov. If the state does allow the activity, then it is not illegal in the state and should be covered in the policy unless excluded or a sub limit applies. The only thing the agent really could have done is discuss the activity with underwriting and review the policy language, then the agent or underwriting could advise the client in writing as to coverage or discontinuance of the policy. In CA most of my carriers exclude marijuana unless there is a valid prescription and then they limit the coverage.

    Hmmm, I now believe that this is a little skunky Agent E&O. Statement, insured alledges they reported this to broker. Broker states he did not report it to the insurance company. END OF STORY!
