Man Charged With Ninth DUI In Montana

October 16, 2012

Authorities in Billings say a 51-year-old Montana man has been charged with his ninth drunken-driving offense.

The Billings Gazette reported that James Alan Tate was arrested Wednesday and is being held in the Yellowstone County jail on $18,500 bail.

He has been charged with felony DUI and misdemeanor counts of driving without insurance and driving without a valid license. Police say he was pulled over for having a broken tail light.

Police say a preliminary blood-alcohol level was 0.361 percent, more than four times the legal limit of 0.08 percent.

Police say a second breath test at the county jail after his arrest measured his blood-alcohol level at 0.263 percent.
