Cinemark Seeks Dismissal Of Colorado Theater Shooting Suits

Cinemark USA is asking a judge to dismiss lawsuits alleging the company failed to protect its customers from the July shootings at a Colorado movie theater that killed 12 and injured 70.

The Denver Post reports Cinemark filed a motion in federal court Monday arguing the lawsuits don’t show the company is liable under the Colorado Premises Liability Act.

Last month, a magistrate recommended that a federal judge dismiss the lawsuits’ claims of negligence and wrongful death against Cinemark. However, the magistrate said the claims that Cinemark violated the state Premises Liability Act could go forward.

That law covers slip-and-fall lawsuits, among other things.

James Holmes is charged with multiple counts of murder and attempted murder in the theater shootings. He is scheduled to enter a plea in March.
