    This single sentence explains the entire scenario: looking to legislate from the judicial bench rather than by traditional means of congressional channels. If and when we have true Tort Reform, these legal blackmailers will fade away once they, instead of the public-at-large, have to foot their own legal bills every time they feel the whim to file frivolous lawsuits to further their political agenda.

    Law is often made this way. It’s called case law. There’s nothing back-alley about it.

      Our judicial system was created to interpret law, not to make law. Case law is not where our judicial system get to decide they want to change law, but instead case law (previously known as common law) is when a higher court sets a precedent for how future cases similar in nature are to be handled. Allowing our Supreme Court to legislate from the bench is to allow tyranny as to do so is giving power to rule to 9 Supreme Court Justices. That goes against everything this country was founded on.

        When they interpret the law, they make the law. It may not be statutory, as criminal law is, but it is the law just the same. It’s not tyranny, it’s how our judicial system works.

        And I don’t remember any mention of SCOTUS here.

    I wonder if they are also going to sue the makers of the butter flavoring used on the popcorn? I smell diacetyl lawsuits waiting in the wings.

    Stop.. Just stop. Its not going to bring your daughter back, its not going to put the company “on notice”. Grieve as you wish but this does not seem like a constructive way of furthering the issue

    I think sewing the ammo manufacturer and the ammo seller makes perfect sense. My niece was hit by another driver and almost killed. Now, should she sue Pete’s gas-n-go for selling the other driver the fuel so he could drive his car to the place where he rammed into her, sue Shell for making the gasoline he used, or both? What do you have when you lay 10,000 lawyers on the floor of the ocean? A good start!
