Re: Calling non-pay clients... a good idea or an E&O exposure?
Mhutch69-Read the same issue. The majority opinion held that there was one previous instance, several years in the past, which the court stated did not constitute a repetitive action or business model. The narrow scope of the majority opinion seems to imply that anything more than a one-time or isol...

Re: Dateline on Fixed Index Annuities
Not to beat a dead horse, but with 35 years experience in Financial Services (ser 7/63/65, L&H, P&C), I am willing to bet that price was an objection (or would have been) had permanent insurance been proposed vis-a-vis the term that was purchased. Thirty year term was available even back the...

Re: Dateline on Fixed Index Annuities
Just a quick comment on the term insurance...why didn't the agent discuss the conversion privilege under almost all term policies? Best of both worlds-invest the difference and, if circumstances change, still have the option to continue on a permanent insurance basis. As to Dateline, they make their...

negotiating on behalf of client
That is akin to being a dual agent in Real Estate. You cannot serve two masters. How can you try to convice the one side to accept lower limits, while advising the client to purchase higher limits. Guess who is on the hook if there is a large claim? All fingers will point to the broker and a good la...

Broker Fee
Thinking of expanding P&C business to Arizona, Texas, Florida and South Carolina. Have called two State Insurance Departments (AZ & TX) and get conflicting answers. Is anyone aware of permission to charge broker fees' regulations and/or restrictions in those states? Have always used disclosu...

Back to the legal vs. ethical discussion of a few weeks ago (regarding leaving an agency and contacting that agency's clients) This time it is the opposite. It is illegal; she is commiting fraud against the carrier and her employer. The carrier pays out and the employer's rates go up. Cut and dry! Y...

If you were on salary, your allegience is to your employer. One way or the other, he paid for that business-either by paying you or generating the lead that directed the customer to the office. Nowhere did you state that you had any hand in soliciting the customer. All that aside, where are your eth...
