Re: Agency's Ownership status
I assume you're in Texas. You can probably check on the Secretary of State's website as long as you have the corporate name. The information sometimes has the registered agent (who may or may not be the owner), but if you can access the annual reports, they are usually signed by the president or VP ...

Boeckh and Marshall & Swift merged a few years ago; one entity now.

Re: Workers Compensation for Camp
Hokie,
Go to MyNewMarkets.com and click <Search>.
Type in "Camps" and VA. A good list pops up.
K&K specifically lists Work Comp for Camps in VA and gives you various phone numbers based on state in which the camp is located.

Re: Agency Fee
I'm not positive about Texas, but I do know that in some states to charge a fee it must be clearly posted in the office and the insured must sign an acknowledgement that there is a fee involved (I'd recommed at every renewal). Both of these must state how much or what percentage the fee will be. And...

Re: Agency Corp Status C vs S ??
Not being an accountant myself, just a former agency owner, I can only offer an opinion. Depends on what your goals are. "C" Corps are taxed as a legal person, and then you are taxed. The advantage is the "C" Corp can put aside money for capital improvements and growth, just taxe...

Re: BUILDER RISK
See exclusion j.5. in the CGL. Real property Care, Custody, Control exclusion. Questions may surround the word "particular." The GL does not provide coverage equivalent to the builders risk. If it's an existing structure, there should be a property policy already in effect that would cover...

Re: Newbie Question
Hey Newbie, You sound like you have a good history in insurance and excellent educational qualifications; sadly, your clients (or potential clients) don't really care. Take it from someone that has multiple designations, many years of experience and the previous owner of my own agency. I take it you...

Re: Certificate Holder - "Endeavor to mail"...
In some states, the certificate of insurance is considered a filed form and any alteration of the form's pre-filled wording is a violation of statute. Some, but only a few, carriers do have a filed manuscript endorsement that removes the "Endeavor to.." wording; but it's rare that these ca...

Re: Demand for Medical Payments
Provided there haven't been a rash of Med Pay claims, this should have very little effect. Again, the establishment is not admitting negligence (if any payment is made at all), so one won't be that big of a deal.Thanks. How does a payout on med pay affect the insured's ability to renew coverage?

Re: Demand for Medical Payments
My opinion is the attorney is just looking for easy money and since med pay does not require negligence be proven to collect (only that an incident happened), he wants to tap that well. Since it appears to be excluded, and he ain't gonna get anything he's got to decide if it's worth his trouble to t...

Re: Damage to "Your work" exclusion on CGL policy
I'm still looking for a good answer on what happens when the CG 22 94 is attached (exclusion for work performed by a subcontractor). Then there is no coverage for the GC's or the subs work (NOTHING is covered, again). I'm not convinced that this exclusion has not been misapplied for too long. As I s...

Re: Building Ordinance or Law on Commercial Building
Look at the California Insurance Code 2050-2060. Not sure if this will completely answer the question. Worth a shot. Thanks, that is what I was trying to find out. How would I know if this applies in CA?
