Re: Yellow Page ad co's filing suit-anyone experienced this?
To all respondents providing legal advice: I avoided litigation with DEX by PROVING that I was ONLY willing to pay for the actual benefit obtained by the YP ad. Dex settled for $20,000 on the bill of $181,000!!!!!!!!!!!! Please read that again. I paid an additional $5,000 for quality representation....

Broke Insurance Agents
OOPS. Did I misspell? NO! The franchisor is changing things further to MAKE SURE that the "franchisees" have NO chance in hell to break even. All historical advanced commissions are now paid as earned, I hear. Broke could not properly calculate the actual earned premium from what I have se...

Re: No compete clause
As far as burying them with legal fees, a start up would not be able to withstand ONE properly worded lawsuit. I can allege and most likely prove the prior employee has taken trade secrets etc. where the case law exists to keep the case going for a while. The legal defense costs would stop them from...

Re: No compete clause
Typical CA. allowing employees to screw big bad employers. I have employees sign that they will not steal customers nor solicit other employees to leave either. If one of my employees opened up next door, I will test the non-compete agreement and wipe them out with legal fees if nothing else. (espec...

Re: Self Employed vs Work for a company
Do BOTH! Nothing better than hiring qualified management to run and build your own businesses while you run and build businesses for larger companies.

Re: WHO TAKES CASH AND DOES NOT REQUIRE MONEY ORDERS?
This was my original post and I will explain further to help clarify. I write personal lines non-std auto and cleary encourage our clients to pay within our office each month rather than NOT paying at all. This is typically the choice as most do not have benefit of banking facilities due to past act...

Re: WHO TAKES CASH AND DOES NOT REQUIRE MONEY ORDERS?
The reason for my inquiry is that several non-standard auto agencies in Arizona were robbed at gun point recently due to "talk" among employees or customers who knew more than they should have. It was somewhat of an inside job... We write non-standard auto and many do not have banking opti...

Who takes cash and does not require money orders?
Does anyone STILL accept cash for ANY reason in a retail insurance office? Just wondering as some clients are not totally honest and "might" show back up later in the day or week and burglarize the office to obtain all the cash they WATCHED the office collect?
Just wondered?

Re: Agency Corp Status C vs S ??
From my experience, a corporation is rarely ever penetrated absent fraud. Not negligence, but fraud. That is from two attorneys I have used for 20+ years, both of which were prior Directors of Insurance. (not that that means much) But, both are good counsel. I would incorporate as an "S" C...

Re: Postcard mailers
dev1, postcards for non-standard auto are very expensive due to the minimal response to that method of advertising from any other product. 1% is a decent return as far as response, then you have to sell them insurance. It is very difficult to separate non-std risks using mailings. I have found postc...

Calling on non-payment customers
Well guys, I have been calling late payment policies in non-standard auto insurance for 30 years. We may not have called every client everytime and have never had a client suggest our lack of a phone call "caused him NOT to pay". Secondly, the legal notice of cancellation sent by the compa...

Re: Licensing Question
Greg Culley, I would gladly assist with any Arizona risks. My agencies have been in business since 1960 in Phoenix. We are licensed to write in AZ. & NV. NV. just eliminated, via court case, their protectionist "countersignature" law. Finally, it is NOT required to pay the resident age...
Re: EPLI
Sal,
One primary reason for purchasing EPLI is for the coverage that is now excluded on most GL policies. For example, employer discrimination in hiring/improper hiring, improper termination, sexual harassment, and all the other that go with that exposure.
Today, EPLI is required for any business.

Come on Rosemary? Brooke, Indepenent?
Rosemary, You are very agressive to recruit off this blog. I am surprised you would enter Brooke's name into this subject and be truly trying to help this young lady. Milliniagirl, (sorry for spelling), please read the other posts and understand the "Brooke Franchise Agreement" before sign...

Sundance, I understand your reluctance to accept an email such as the one I used. Temporarily, I am not interested in disclosing the name of the company and direct selling retail agency until we have completed all the necessary secretary of state filings and DOI filings in order to preserve our name...
