Re: Calling non-pay clients... a good idea or an E&O exposure?
You are not following company policy and creating E&O exposure. I don't want to sound mean but for me, you would be looking for a new job as soon as say........yesterday. Yes not documenting calls does sound and IS crazy. If you like your job you should clean up your act. :) But since it is a ra...

Re: Apartment complex wants to be additional interest
It is Encompass and I don't think, the last time I checked, they are a loser company. That means Allstate won't do it either. I called a friend that has been in the business for over thirty years, works at an agency with 90 employees, they have a lot of ins. company contracts and she said none of th...

Re: Calling non-pay clients... a good idea or an E&O exposure?
I'm not saying I won't ever make the call. If it is out of character for a certain client I will make a call. Other than the E&O issues involved in calling bad pay clients, there is also the morale issue. Clearly if they don't care enough to pay insurance on time, then what else don't they care ...

If they can sue and win for failure to notify of cancellation http://www.uticanational.com/NewEandOsite/LessonsLearned/NotifyCancellation2.htm#Claim2 They can sue and win by proving it was your standard practice to notify them of late payments. Just think like the attorney and you can come up with t...

Re: Calling non-pay clients... a good idea or an E&O exposure?
Yes being sued can't be stopped. Keeping the person suing from winning the suit is the key. I don't believe what the previous agent did has anything to do with your E&O exposure unless, you tell them you will do what the other did for them. After 26 years in the business as an agency owner, my a...

Re: Calling non-pay clients... a good idea or an E&O exposure?
Over twenty years ago I remember an E&O seminar saying you should not engage in such actions. Their reason was, once you start the exercise, the other party has legal recourse to come against you if you forget to call them. In other words, the onus lies with you to keep after them to pay. On the...

Re: Apartment complex wants to be additional interest
The association has no interest in the contents and if the need arises the association could file a claim against the tenants liability. Here is their reason and it does make sense. Underwriter and customer service rep The Association cannot be added as they have no interest in the policy. This is s...

Re: Apartment complex wants to be additional interest
This is the form I am using: G1-71026-A Ed. 04-04 and I can not find it within the form. It seems to be an ISO form because it has the wording: Includes copyrighted material of Insurance Services Organization. I executed a search on the policy PDF and there were two incidents of the word contract. O...

Re: Apartment complex wants to be additional interest
IS the same language in the ISO HO policies? I can't remember but I don't think so. AAIS FORM 3 Ed 2.2 2. Contracts and Agreements -- "We" pay for damages for "bodily injury" or "property damage" where the liability of others is assumed by an "insured" under a...

Re: Apartment complex wants to be additional interest
Very true. I have a renters insurance client. The complex is making renters insurance a qualification for signing a lease. The problem is the complex wants to be manuscripted as additional interest or interested party. The insurance company will not do it. Reasons against it seem obvious because it ...

Re: Premium basis in Schedule of Hazards
Well in my part of the world, if you buy a row home, you get all property in its entirety. You can't just buy th second floor, third, floor, etc. Property ownership of a building have not been split like they may be in New York City. I would imagine in NYC, you can buy a closet size room on the thir...

Premium basis in Schedule of Hazards
I'm not usually writing this type of account and it has been far too long....or am I just getting old. Perhaps it is having only 3 hours sleep. :( The client purchased a residential row home that has been converted into two different apartments. In completing the Acord 126, I realized that under the...

Re: Additional Insureds in Workers Comp
A problem can arise when the contractor temporarily lends or leases its employees to someone else. Would not the alternate employers endorsement WC 00 03 01 A cover such employees under the contractor’s workers compensation policy? I always take the stance that a request for additional insured statu...

Re: To those that think I am crazy that the SEC may
I don't like tromping on ya big dog but I also have a bit of a mission to at least clear up all the misleading info. People talk of complexity. I ask this, If I sit down and go over the algebraic expressions for the computation of each different crediting method, will that effect the buyers decision...
